Terms and conditions of sale

Terms of payment

Payment is due in full on receipt of an invoice issued by the training organization to the beneficiary.

 

Failure to provide training

In application of article L6354-1 of the French Labour Code, it is agreed between the signatories of the present agreement that in the event of total or partial termination of the training service, the training organization must reimburse the co-contractor for any sums unduly received as a result.                        

Obligations and force majeure

                    

Within the framework of its training services, "GLOBAL AFFLUENCE" is bound by an obligation of means and not of result towards its Customers or its Trainees. "GLOBAL AFFLUENCE" may not be held liable to its Customers or Trainees in the event of non-performance of its obligations resulting from a fortuitous event or force majeure. The following are considered fortuitous or force majeure events, in addition to those usually recognized by jurisprudence: the illness or accident of a speaker or pedagogical manager, strikes or social conflicts external to "GLOBAL AFFLUENCE", natural disasters, fires, interruption of telecommunications, energy supply, or transportation of any type, or any other circumstance beyond the reasonable control of "GLOBAL AFFLUENCE".                

 

Quotation and certificate

                    

For each training course, two copies of a quotation are sent to the Customer by " GLOBAL AFFLUENCE ". One copy duly completed, dated, stamped, signed and marked "Bon pour accord" must be returned to "GLOBAL AFFLUENCE" by e-mail. If necessary, a special agreement may be drawn up between "GLOBAL AFFLUENCE", the OPCO or the Customer. At the end of the training, " GLOBAL AFFLUENCE " gives a training certificate to the Trainee. In the case of partial or total coverage by an OPCO, " GLOBAL AFFLUENCE " will send it a copy of the attendance sheet along with the invoice. A certificate of attendance for each Trainee can be supplied to the Customer on request.

Compensation, reparation or forfeiture

In the event of cancellation by the beneficiary before the start of the training program

  • Between 2 weeks and 1 week before the start of the course: 50% of the cost of the course is due. 

  • Between 1 week and 48 hours before the start of the training program: 75% of the cost of the training program is due.  

  • Less than 48 hours before the start of the course: 100% of the cost of the course is due.

The cost cannot be reimbursed or covered by the OPCO.

Intellectual property and copyright

                   

All the presentation sheets, content and teaching aids, whatever their form (paper, electronic, digital, oral, etc.) used by "GLOBAL AFFLUENCE" to provide the training courses or given to the Trainees constitute original works and as such are protected by intellectual property and copyright. As such, the Customer and the Trainee are prohibited from using, transmitting, reproducing, exploiting or transforming all or part of these documents, without the express agreement of "GLOBAL AFFLUENCE". This prohibition applies, in particular, to any use made by the Customer and the Trainee with a view to organizing or conducting training courses.  

 

Training program and description

Program content, as shown on the training presentation sheets, is provided for information only. The instructor or training manager reserves the right to modify them according to current events, the level of participants or the dynamics of the group.
 

Confidentiality and communication

                    

GLOBAL AFFLUENCE", the Customer and the Trainee agree to keep confidential all documents and information to which they may have access during the training service or during exchanges prior to registration, in particular all elements included in the proposal sent by "GLOBAL AFFLUENCE" to the Customer. 

in the proposal sent by "GLOBAL AFFLUENCE" to the Customer. "GLOBAL AFFLUENCE" undertakes not to communicate to third parties other than the partners with whom the training courses are organized and the OPCOs, the information transmitted by the Customer, including information concerning the Trainees. However, the Customer agrees to be cited by "GLOBAL AFFLUENCE" as a customer of its training courses. To this end, the Customer authorizes "GLOBAL AFFLUENCE" to mention its name, logo and an objective description of the nature of the services in its lists of references and proposals to prospects and customers, interviews with third parties, activity reports, website, as well as in the event of legal, regulatory or accounting provisions requiring it.              

Protection of and access to personal information    

                    

The Customer undertakes to inform each Trainee that :

- personal data concerning him/her is collected and processed for the purposes of monitoring the validation of the training and improving the "GLOBAL AFFLUENCE" offer 

- in accordance with French law no. 78-17 of January 6, 1978, trainees have the right to access, modify and rectify their personal data. The Trainee may exercise this right by writing to : "GLOBAL AFFLUENCE" or by e-mail to : "GLOBAL AFFLUENCE". In particular, " GLOBAL AFFLUENCE " will keep the data related to the Trainee's course and the evaluation of his/her skills, for a period not exceeding the time required to assess the training. Finally, "GLOBAL AFFLUENCE" undertakes to delete any images taken by any video means during practical work or simulations at the end of the exercises. 

Disputes

If a dispute or difference cannot be settled amicably, the Court of First Instance will have sole jurisdiction to settle the dispute.
