Terms and conditions of use

The https://www.globalaffluence.com/ website (hereinafter the "Site") is published by GLOBAL AFFLUENCE located at 11 AV Marceau, 92400 - Courbevoie, registered under number 880 107 263 00019.

GLOBAL AFFLUENCE is a training organisation offering training for professionals in the Other Personal Services n.e.c. sector.

Article 1. Definitions

 

The terms whose first letter is capitalized herein have the following meaning:

GCU

Refers to these general terms and conditions of use of the Site

GTC

Refers to the two FEL general terms and conditions of sale (defined below), one for Professionals and the other for Consumers, available on the Site.

Consumer

Refers to a natural person of legal age purchasing a FEL on a personal basis, for purposes which do not fall within the scope of their commercial, industrial, craft or liberal profession activity.

Content

Refers to any element, data, application, software, interface, database, work or component of any nature and of any kind such as texts, visuals, images, 

sounds, videos, photos, illustrations, drawings, icons, computer or computer graphics creations, audio and/or video animations of the Site, the Platform or the GLOBAL AFFLUENCE training courses.

Duration

Refers to the period during which the FEL is accessible on the Platform and usable by the Professional or Consumer, once it has been purchased. In all cases, the maximum Duration of an FEL is four months from the date of first access.

Confidential Information

Refers to all information and data of whatever nature, in particular technical, commercial, strategic or financial, as well as, in particular and in a non-exhaustive manner, all documents of any nature, written or printed, all Contents, samples, models, mock-ups, specifications, software, products, reports, descriptions, financial statements, forecasts, market studies, know-how and others presented as confidential by GLOBAL AFFLUENCE, the Professional or the Consumer and transmitted on the Site or via the Platform in writing, orally or by any other means.

Professional

Refers to the Professional carrying out his activity either independently in a form registered under a SIREN number, or in the form of a legal entity under private or public law. The Professional may designate several Trainees as beneficiaries of the FEL or FEP.

Site

Visiteurs

Désigne les personnes physiques ou morales qui consultent le Site ou s’inscrivent à la newsletter sur le Site.

Article 2. Purpose of the GCU

These general terms and conditions of use of the Site (hereinafter the "GTCU") establish the rules according to which GLOBAL AFFLUENCE makes information and its service offer available to any Internet user, and which apply to any person having access to or consulting the Site (hereinafter the "Visitors"). Continued browsing by the Visitor on the Site implies acceptance of these GCU.

GLOBAL AFFLUENCE reserves the right to update and change the TOU at any time and without prior notice. This modification is valid only for the future, and applies to any new feature of the Site. The Visitor's continued browsing of the Site implies acceptance of the new version of the Terms and Conditions.

Article 3. GLOBAL AFFLUENCE offers

 

GLOBAL AFFLUENCE markets training courses for Professionals:

 

  • Either face-to-face by bringing together registered Professionals for workshops at a single location

  • Or remotely via training content made available online via the Site and the content access platform (hereinafter the "Platform").

 

GLOBAL AFFLUENCE also markets training courses for Consumers remotely via training content made available online via the Site and the Platform. 

All GLOBAL AFFLUENCE trainers declare, at the beginning of each calendar year, any links that could lead to a conflict of interest and undertake to respect the following obligations and commitments: duty of probity, independence, impartiality, confidentiality, professionalism and reserve. 

The training programmes are listed on the Site in separate catalogues, depending on whether the training is Face-to-face (FEP) or Online (FEL). These programmes are provisional: there may be last-minute changes to both the content of the courses and the profiles of the speakers. They are detailed by theme in the course catalogues, which also specify the follow-up procedures and types of assessment.

Article 3.1. On-site training (VET)

The In-Person Training Courses are not reserved for Professionals and are not offered for sale on the Site and the Platform. They bring together various and varied audiences at GLOBAL AFFLUENCE's premises at 11 AV Marceau, 92400 - Courbevoie, for classroom training sessions on issues related to Fruit and Vegetables. All of the VET training and course content is handed out during or at the end of the VET.

At the end of the VET course, a satisfaction questionnaire is sent to participants by e-mail on the last day of the course. A second questionnaire is sent four (4) months after the end of the course.

Article 3.2. On-Line Training (OLT)

Online Training Courses are reserved for Professionals and Consumers who place orders for Online Training Courses after accepting the Terms and Conditions. Visitors are expressly referred to these GTC.


Article 4. Conditions of use of the Site

Article 4.1. Browsing the Site

By default, the Site offers the following content and functions:

A presentation of GLOBAL AFFLUENCE, its principles and its trainers; A news feed; A section dedicated to upcoming training courses; The catalogue of training courses offered by GLOBAL AFFLUENCE; and other services described separately in these Terms and Conditions.

 

To access these functions optimally, it is recommended to use the following browsers:

 

Microsoft Edge 15 and later versions; Internet Explorer 9 and later versions; Firefox 3.6 and later versions; Safari 7 and later versions; Chrome 7 and later versions; Opera 12 and later versions.

 

The Professional must ensure that he has, and has made available to the Learner(s), the hardware, software, configurations and other elements required for an adequate Internet connection and access to the Site and the Platform, under his sole responsibility.

Article 4.2. Links to other sites

 

GLOBAL AFFLUENCE proposes on the Site hypertext links towards third party sites. These links are established according to the interest of the contents proposed by these sites, at the time when the links were created. However, these third sites being by nature independent of GLOBAL AFFLUENCE, they can evolve then without notice and GLOBAL AFFLUENCE cannot thus guarantee the perenniality of the accessible contents by these links with the wire of time.

Consequently, GLOBAL AFFLUENCE could not be held for person in charge for the accessible contents starting from the links, and declines any editorial responsibility for this reason. Any Visitor observing a link present on the Site and leading to content that seems obsolete or inappropriate is invited to report it via the contact page. GLOBAL AFFLUENCE assumes no responsibility for the information published on these sites and the hypertext links thus provided do not imply any guarantee concerning the content of these sites.

Article 4.3. Newsletter & Contact form

Generally speaking, Visitors can visit the Site without having to provide any personal information or data. However, in the case of registration for the "Newsletter", requests via the "Contact" form, requests for registration or pre-registration for the FEL and FEP, the Visitor must provide information that may be qualified as personal data, such as the e-mail address. The conditions of GLOBAL AFFLUENCE's Privacy Policy then apply, in particular for the exercise by Visitors of their rights.


In the event of subscription to the newsletter, Visitors may request that they no longer receive it either by objecting to it in accordance with the conditions of the Privacy Policy, or by following the instructions appearing at the end of each of these messages, when Visitors receive them.

 

Article 4.4. Availability of the Site

GLOBAL AFFLUENCE makes the Site available to Visitors, subject to technical contingencies and applicable maintenance periods. The Visitors are informed of the interruptions of access which can result from it. Consequently, GLOBAL AFFLUENCE cannot guarantee permanent accessibility to the Site and cannot be held responsible for any slowdowns or unavailability. Access to the Site is provided within the framework of an obligation of means. 

 

Visitors acknowledge that they are aware of the technical characteristics and hazards relating to loading times, consultation or other transactions carried out on the Internet, the very constitution of the network making it impossible to know the speed of the recipient, the path taken by the data or the rate of availability of the bandwidth. Visitors also acknowledge that they are aware of the risks of breaches of security and confidentiality of data and content sent and received via the Internet.

 

 

Article 5. Protection of personal data

GLOBAL AFFLUENCE undertakes to comply with the law applicable in France relating to the protection of personal data and privacy, i.e. Law no. 78-17 of 6 January 1978 relating to information technology, files and freedoms as amended by the Law of 20 June 2018 and supplemented by its implementing decree of 1 August 2018, as well as Regulation no. 2016-679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

 

Consequently, GLOBAL AFFLUENCE undertakes to comply with these principles and obligations under the conditions set out in the Privacy Policy dedicated to these issues. Visitors are invited to refer to it, in particular to exercise their rights of access, rectification, opposition and deletion.

 

 

Article 5.2. Security and confidentiality of processing

GLOBAL AFFLUENCE, its staff and its subcontractors take all necessary measures to preserve and ensure respect for the integrity and confidentiality of the personal data of Visitors and Learners in the context of the provision of the Site and the performance of the ELFs, and in particular to make the personal data accessible and consultable only to the staff of GLOBAL AFFLUENCE and its subcontracting Partners who are duly authorised and empowered by virtue of their functions and capacity, within the strict limit of what is necessary for them to perform their functions.

 

GLOBAL AFFLUENCE and its subcontractors undertake to implement any security system that complies with current standards, to ensure the confidentiality and security of personal data against the risks of intrusion, leakage, misappropriation or corruption.

 

Article 6. Intellectual property rights

All intellectual property rights relating to the Site, and in particular all copyrights, trademarks, designs and models, databases or software of GLOBAL AFFLUENCE and the rights of reproduction, representation and adaptation arising therefrom belong to and remain the property of GLOBAL AFFLUENCE, without any of the stipulations of the Site's GTUs being interpreted as assigning or transferring the slightest property right to Visitors or to any third party.

 

In accordance with article L. 122-4 of the French Intellectual Property Code, it is forbidden to reproduce, copy, modify, transmit, distribute in any way whatsoever, even partially, on any type of medium, any element from this Site (for example, but not exclusively: texts, logos, images, sound elements, videos, software, icons) without the prior explicit written authorisation of GLOBAL AFFLUENCE.

 

Article 6.1. Limitation of use

In accordance with article L. 122-5, first paragraph, of the French Intellectual Property Code, the reproduction of an element of the site for personal and private use is authorised, which expressly excludes any re-use for commercial purposes and any transmission to a third party whatsoever. The Visitor is hereby informed that any unauthorised use of all or part of the Site is liable to prosecution, and shall refrain from any communication to third parties or any re-use for purposes other than training.

 

Provision of the Site does not imply authorisation for Visitors to use the trademarks and distinctive signs of GLOBAL AFFLUENCE, its partners, service providers and subcontractors, or any content protected by intellectual property rights. Any unauthorised appropriation or use of all or part of the Site, trademarks or distinctive signs mentioned above engages the Visitor's liability towards GLOBAL AFFLUENCE, notwithstanding any recourse by GLOBAL AFFLUENCE.

Any use of the Site other than that authorised by these GCU is prohibited. In this respect, Visitors are prohibited from making any temporary or permanent reproduction of all or part of the Site, by any means whatsoever. Furthermore, it is forbidden to disseminate, distribute or make available, directly or indirectly, all or part of the Site to a third party or to the public, whether free of charge or in return for payment, or to translate, adapt, arrange or modify the Site, in particular with a view to creating a similar service. Similarly, the extraction or re-use of a qualitatively or quantitatively substantial part of the databases used by the Site is prohibited.

 

Article 7. Liability

 

GLOBAL AFFLUENCE undertakes to make the Site available and to provide relevant information within the framework of an obligation of means. The Visitors use the Site at their own risks. GLOBAL AFFLUENCE cannot be held responsible for any occasional and unexpected errors that may occur on the Site. GLOBAL AFFLUENCE invites any Visitor who notices an error to report it to GLOBAL AFFLUENCE via the contact page.

Each of the parties assumes responsibility for the consequences resulting from its faults, errors or omissions, as well as the faults, errors or omissions of its service providers and subcontractors, if any, and causing damage to the other party, under the conditions herein. They undertake not to use the Site and the Content in a manner contrary to the law applicable to electronic communications, nor to assist in such use.

 

Regardless of the FEL or FEP in question and in any event, GLOBAL AFFLUENCE may under no circumstances be held liable for any indirect prejudice suffered by Consumers, the Professional, the Learners or third parties, and in particular for any loss of data, customers or prospects, loss of opportunity, loss of earnings, increase in costs, action or claim brought by a third party against the Professional, the Consumer or the Learners, absence of or poor response to commercial prospecting, without this list being limitative. In the event of a breach by GLOBAL AFFLUENCE proven by the Professional, the Consumer or the Learner, the liability of GLOBAL AFFLUENCE for direct damages proven by the latter is limited to the price of the FEL or FEP concerned.

In addition, in the event of a dispute, GLOBAL AFFLUENCE may validly provide proof of the actions and validations of the Professional, the Learners and the Consumers using the connection logs, statements and other elements received, generated or stored by GLOBAL AFFLUENCE, which alone will serve as proof, which the Professional, the Learners and the Consumers acknowledge.

 

In any event, GLOBAL AFFLUENCE reserves the right to interrupt the FEL(s) as well as access to the Site and/or to delete the litigious content from its servers or those of its partner, without prior notice or compensation to the Visitors, notwithstanding GLOBAL AFFLUENCE's right to pursue compensation for any damages it may have suffered.

 

Article 8. Confidentiality

Consultation of the Site is not covered by an obligation of confidentiality, but exchanges with the GLOBAL AFFLUENCE teams, in particular following use of the contact page or requests for registration or pre-registration on the Site, have the character of confidential Information.

 

Each of the parties undertakes (i) to keep confidential all Confidential Information that it receives from the other party, and in particular (ii) not to disclose the Confidential Information of the other party to any third party whatsoever, other than persons who need to know it for the performance of these GCU; and (iii) to use the Confidential Information of the other party only for the purpose of exercising its rights and fulfilling its obligations under these GCU. The Professional is responsible for ensuring that its Learners comply with these obligations.

 

The obligations of the parties with regard to Confidential Information remain in force throughout the period of consultation of the Site and for as long as, after its termination, the information concerned remains confidential for the party disclosing it and, in any event.

GLOBAL AFFLUENCE undertakes to ensure that its subcontractors (routers, DSP, etc.) comply with the security and confidentiality conditions of the Confidential Information hosted, and ensures the implementation of physical and logical security measures and the necessary access restrictions, as part of an obligation of means.

 

Article 9. Miscellaneous

 

Article 9.1. Force majeure

 

In the event of force majeure, GLOBAL AFFLUENCE's obligations relating to the Site will be suspended for the duration of this cause. Expressly, are considered as cases of force majeure those usually retained by the jurisprudence of the French courts and tribunals, as well as the cases of fraudulent introduction on the computer system and/or hacking of the data of GLOBAL AFFLUENCE.

 

Article 9.2. Subcontracting

GLOBAL AFFLUENCE uses Partners to provide all or part of the Site, and in particular a hosting provider. Consequently, it is agreed that GLOBAL AFFLUENCE may entrust to a subcontractor all or part of the services stipulated in these GTUs, and uses professionals providing services that comply with the state of the art. However, GLOBAL AFFLUENCE remains liable to the Visitors for the subcontracted services, under the terms of the "Liability" article above.

Article 9.3. Other

 

The GTU express the entirety of the obligations and agreement between the parties and supersede all other agreements, written or oral, concerning its subject matter. GLOBAL AFFLUENCE reserves the 

the right to modify the content of these GTUs at any time to take into account any technical or regulatory change applicable to the Site, without prior notice. Visitors are informed via the Site.

 

 

If any stipulation of the GCU is invalid, the other stipulations will remain in force. The parties will then agree to adopt a new stipulation which will replace the provision in question.

 

The fact that one of the parties does not require the application of any clause of the GTU may in no case be considered as a waiver of the rights that it holds in the GTU.

 

 

GLOBAL AFFLUENCE reserves the right to assign all or part of its obligations to any third party of its choice. In addition, the GTU do not include any exclusivity, GLOBAL AFFLUENCE remaining free to make any service of the GLOBAL AFFLUENCE catalogue available to customers other than the Visitors, directly or indirectly, without restriction.

GLOBAL AFFLUENCE elects domicile at its address in these GTUs.

 

Article 10. Applicable law

 

The GTUs are governed by French law. Any dispute arising from the formation, interpretation, performance or termination of the GTUs for any reason whatsoever shall be subject to an attempt at conciliation between the parties. Failing conciliation, any dispute between the parties arising from the formation, interpretation, performance, cessation or termination of the GTUs will be brought before the competent court of GLOBAL AFFLUENCE, even in the event of multiple defendants or third party proceedings.
